How do we restore America as a Constitutional Republic

In joining a group recently, I was asked to explain what I would personally recommend (or do, had I the proper authority to do so) to restore the American system back to its original intent as a Representative Constitutional Republic.

The Bold Print is highlighting the answers I gave to the original question and the print thereafter, is something of an explanation as to why I would take these steps and what I hope would be accomplished by their implementation.

Demand a comprehensive understanding of not only the Constitution, but of the Federalist and Anti-Federalist papers for all people electing to seek public office and for any and all judges, at every level.

Are we already living in the police state

The government is definitely smart enough to know that they cannot just come in and declare themselves to be in absolute and complete power. The nation would rapidly devolve into a revolutionary state. Likewise, bringing in foreign troops to “quell” riots and domestic disputes would end up virtually the same, with the American people rising up in arms.

Thus, if the USA is ever going to commit to the establishment of a police state … as it already has as far as I am concerned, though that remains subject to debate … it must do so incrementally, constantly testing the will and the veracity of the constitutional patriots who remain … and among whom I have no shame about proudly declaring myself.

Is Washington DC Part of the United States of America?

Recently, a seemingly distinguished person effectively dismissed the idea that the Federal District of Washington, District of Colombia, is not in fact part of these independent but united States of America … and while it would seem an easy question to answer concisely and lay to rest, such matters of law and legalese are never quite so simple in reality.

As my answer, even working largely from memory, has turned into nearly six thousand words, I have included the very short version of my answer in the opening phases with other observations, comments and references throughout the rest of the article. The rest of the article looks at the corresponding perversion and combination of the economic and legal systems and some of how it relates to the lack of liberty and freedom today.

The Left and Right Political Paradigm and Circular Logic

For those that believe and put faith in the Legal Fiction we know as the “State”, there is often a great deal of confusion regarding the whole “Left/Right Paradigm” and which ideologies are on the left and which are on the right. Many of these same people often say what they think, though not necessarily what they mean, which is almost inevitable given the abuse and “evolution” of language resulting in words having meanings very different from their historical meaning. (For example, the current definition of what many of us here are old enough to remember as the # or Pound Sign, is now commonly referred to as a Hashtag … which is a natural evolution of a word. Whereas Democracy is inherently evil and ultimately nothing more than mob rule … the introduction of democracy as a means of saying republic, is a perversion of the word and the language)

Is a corporation a person? Can it be? Should it be?

FROM BLACKS LAW:

Persons are the subject of rights and duties; and, as a subject of a right, the person is the object of the correlative duty, and conversely. The subject of a right has been called by Professor Holland, the person of inherence ; the subject of a duty, the person of incidence. "Entitled" and "bound" are the terms in common use in English and for most purposes they are adequate. Every full citizen Is a person; other human beings, namely, subjects who are not Citizens, may be persons. But not every human being is necessarily a person, for a person Is capable of rights and duties, and there may well be human beings having no legal rights, as was the case with slaves in English law. • • • A person is such, not because he Is human, but because rights and duties are ascribed to him. The person Is the legal subject or substance of which the rights and duties are attributes. An individual human being considered as having such attributes is what lawyers call a natural person. Why is a corporation a person?

Once again, people are often confused when it comes to legal terminology, often even insisting that “details” are not all that important or are somehow or another more extemporaneous in nature and not necessarily relevant. Believe it or not however, there is a reason for the old adage, “The devil is in the details” … because indeed, those little details can screw you to the point of losing everything that you have ever owned in addition to your freedom. While deciding whether or not Corporations are Persons or even people, may seem like an easy question to answer with a definitive and resolute “No!” … as a very wise man once said, the devil is in the details.

First, it becomes necessary to understand exactly what is meant by a “Person”. Simple right? Or is it?

Did Jefferson see what the federal government would become if left unchecked?

When these independent but united States of America were formed and openly declared their separation or independence from the British Crown, there was a Confederation of independent but united States. A Confederation or more accurately, a National (or Nationalist) Confederation wherein certain few and well defined powers were granted to the National Government in order to strengthen the ability of the independent but united States to conduct matters of international diplomacy and trade and to ensure that peace was maintained by and between the independent States, with only marginal powers being granted to conduct international warfare.

After the War for American Independence, this was ultimately changed to a Representative Constitutional Republic that was still by all considerations, a Nationalist union of independent and largely sovereign States within Continental America. Included in this documentation was a “Bill of Rights” … the rights of the independent States to declare their sovereign authority and the recognition of God-given rights (or rights granted by “the Creator”) and the inability of the national (now federal) system to infringe upon those individual Rights. Among the more notable of these in regards to the independent but united States of America was the Tenth Amendment which clearly states that all rights that are not specifically granted to the national government are reserved to the States and to the People.

One of the issues I wish to explore here is the ability of the governments and the proverbial powers that be to obfuscate through the utilization of very effective disinformation campaigns. This disinformation has proven to be very effective and is one of the primary tools for deflecting any questions about the world and the economic and financial systems in particular. The end result, when someone does begin to present the truth, cries of “Oh! You are one of THOSE people!” or “That's all crazy talk” or “Oh here we go with the conspiracy theories again” … etc etc et al ad infinitum … fill the air and any subsequent knowledge that is passed on is either ignored completely or silenced before it can reach its intended audience.

(20 years after enactment of the Federal Reserve Act)

On June 5, 1933, Congress enacted HJR-192 to suspend the gold standard and to abrogate the gold clause. This resolution declared that "Whereas the holding or dealing in gold affect the public interest, and are therefore subject to proper regulation and restriction; and whereas the existing emergency has disclosed that provisions of obligations which purport to give the obligee a right to require payment in gold or a particular kind of coin or currency. . . are inconsistent with the declared policy of congress. . . in the payment of debts.

This resolution declared that any obligation requiring "payment in gold or a particular kind of coin or currency, or in an amount in money policy; and . . . Every obligation heretofore or hereafter incurred, shall be discharged upon payment, dollar for dollar, in any coin or currency which at the time of payment is legal tender for public and private debts."

A farm control bill around the same time period had attached to it a clause making Federal Reserve notes legal tender. In 1937, the Supreme Court struck down the Farm Control Act, thus carrying with it the legal tender status of Federal Reserve notes. Prior to 1933, Federal Reserve notes were used for inter-bank transfers. Around 1945, Congress passed a bill which called for the withdrawl of Federal Reserve notes from public circulation; but, they are still with us. . . *NOTE that the words do not talk about "payment" of debt, but clearly states that "Every Obligation . . . Shall be discharged."

What is the role of government?

Government should be relatively easy to define … but is it? Why do we need government? These days, government is effectively little more than the ruling class, creating seemingly arbitrary laws and regulations, and pawning off its responsibility to others. Why is government necessary though? What is the actual purpose of government? Can people live without the formal establishment of government and effectively govern themselves?

Why do we need government?

Where is the illusory rabbit hole? Or are we already in it?

It is very likely that most people here know the story about Alice in “Wonderland” and how she fell down the rabbit hole into a strange and madcap world. Despite the absurdities of the world she discovered however, the consequences of such a world were very real indeed. If the red queen had managed to take the head of Alice, it is fairly safe to presume that the book would not have had a happy ending. Likely, her story never would have been told at all, though that is not really the point of this article.
